Talent Solutions, s.r.o. is committed to protecting and respecting your privacy. This information document describes your rights relating to the Personal Data we process about you and the steps we take to protect your privacy. Explanation of terms

First, we would like to explain the meaning of certain words in this document. It may seem obvious, but in this document you will be referred to as “you”.

Where we refer to “us” or “the Company”, we mean Talent Solutions, s.r.o., whose registered office is Digital Park III, Einsteinova 19, 851 01 Bratislava, Slovak Republic. Through its subsidiaries and business activities we provide a range of services in HR, such as job placement, temporary staffing, payroll accounting services, recruitment and selection, employee testing solutions, career transition, talent development, training and education, job transition and international mobility (“our Services”).

The Company uses several IT systems to provide its Services. One of these systems is an Internet portal (the Portal”) through which the Company and other Talent Solutions Group entities advertise job opportunities from which a candidate can choose and apply to the one that matches their interests, skills, and/or experience and that is in a location where they would be interested in working.

Finally, we would like to state that this document relates to information about people, which includes the facts relating to you, but also opinions about you and your views (e.g. information about being a football fan). This is not information about the Company (although they sometimes overlap). This type of information is called “Personal Information” or “Personal Identifiable Information”. We use the term “Personal Data” in this document.

What Personal Information does the Company collect and use?

The Personal Data that the Company generally collects includes, but is not limited to:

  • your first and last name, contact details and your qualifications (education, training, and internships), documents proving your work authorizations, and other information listed in your CV;
  • basic data from your profile, if you have logged in to the Portal via your LinkedIn or other social networking accounts;
  • data available on your public LinkedIn profile may also be used in the selection process;
  • a record of communication with you if you have contacted us yourself and
  • for the purposes of the Act on Employment Services, also data on nationality, gender, birth number or other identifier, data on the employer or user employer, type of employment relationship, work position, date of mediation of employment and the date and expected duration of the employment relationship or temporary assignment depending on whether our activity will be an employment mediation for our client or a temporary assignment. The detailed scope of personal data processed in case of employment mediation is listed in Annex no. 1 letter J. of the Act on Employment Services and in case of temporary assignment in Annex no. 1 letter I. of said Act.

 

Why do we use your Personal Data?

To enable us to provide you with the service you expect from us. This service is to find suitable employment for you, either through agency employment, where the Company is an employment agency, or directly with our client as your prospective employer. This service includes communicating with you, conducting the selection process, assisting you during the recruitment process with the potential employer, passing on your Personal Data to potential employers, etc. Some of your data is collected and processed in order to ascertain and assess your experience and professional skills.

 

What is the legal basis for processing your Personal Data?

Any processing of Personal Data must by law be based on one of the permitted legal bases.

  • Performance (or conclusion) of a contract. The processing of your Personal Data for the purpose described above is necessary for the performance of measures taken prior to the conclusion of a contract at your request. This means that we need to process your Personal Data in order to provide you with a service that results in entering into a contract with you and entering into an employment relationship.
  • Legitimate interest. We rely on the legitimate interest of the Company to process Personal Data for the purpose described above.

 

Is it your obligation to provide us with your Personal Data when we ask for it?

You are not obliged to provide us with your Personal Data, but unless you do, we will not be able to properly offer you our service described above.

 

How long do we keep your Personal Data?

We will keep your Personal Data for as long as we provide you with the service described above. This means that we will process your Personal Data for the purpose described above until you enter into an employment relationship with us or our client, or until you are definitely dismissed as an employee by us or our client.

Do we transfer your Personal Data to third parties?

We may transfer or disclose your Personal Data to third parties. We do so in the following situations:

  • Transfers to our vendors (third party service providers). For example, we may engage our contractor to perform administrative and operational activities in the provision of our services. This supplier will have a contractual and legal obligation to maintain the confidentiality of your Personal Data and respect your privacy and will only have access to the data they need to do their job; such suppliers are typically IT suppliers (who provide us with IT systems where information about you is also stored) or accounting and financial service providers (who need to know data about applicants in order to e.g. issue and process invoices correctly).
  • Passing on to our clients (potential employers). We will share your Personal Data with our clients who offer you a job in which you have expressed an interest or which we consider suitable for you. Our clients have a contractual obligation to us and to you to maintain confidentiality with respect to your Personal Data.
  • Transfers to Central Office of Labour, Social Affairs and Family. Based on Section § 28 letter a) and Section 31 par. 1 letter f) of the Act on Employment Services we are obliged to keep records of natural persons for whom we have mediated employment or who we have temporarily assigned and to provide this data to the Central Office of Labour, Social Affairs and Family.

 

Do we transfer your Personal Data outside the European Union?

Outside the European Union, your data is only transferred to countries that are considered by the European Commission to have an adequate level of protection under Article 45 of the GDPR, or the conditions set out in Article 46 of the GDPR are met. Further information is available on the Company’s website in the Privacy Policy section.

 

What rights do you have in relation to the processing of Personal Data?

 

  • The right to access and obtain a copy of your Personal Data. You have the right to obtain confirmation from the Company as to whether it is processing any of your Personal Data. If it does, you have the right to access that Personal Data of yours (e.g. through the Portal) and certain information about its processing. You may also ask us for a copy of your Personal Data.
  • Right to portability of your Personal Data.Where we process your Personal Data by automated means, you have the right to obtain from us the Personal Data that you have provided to us in a structured, commonly used and machine-readable format and, where technically feasible, you have the right to require us to transfer that Personal Data to another entity.
  • Right to rectification of your Personal Data. If you prove to us that the Personal Data we process about you is incorrect, you may request that we update or correct it. In certain cases, you may update your Personal Data yourself through the Portal.
  • Right to the erasure of your Personal Data (right to be forgotten).You have the right to have your Personal Data erased in certain (legally required) cases. You may submit a request for erasure of your Personal Data at any time and we will evaluate whether your request will be granted. If we conclude that there are grounds for erasure of your Personal Data, we will do so without undue delay. Please note, however, that if your Personal Data is deleted, we will no longer be able to provide you with the service you expect from us. If you wish to request this service again at a later date, you will need to provide us with your Personal Data again.
  • Right to restrict the processing of your Personal Data. You have the right to restrict the processing of your Personal Data in certain (statutory) cases. However, please be aware that this restriction of the processing of your Personal Data may limit the service we provide to you.
  • Right to object. If we base the processing of your Personal Data on our legitimate interest, you have the right to object to this processing on grounds relating to your particular situation. The Company will then only be entitled to further process your Personal Data if it demonstrates compelling legitimate grounds for the processing which override your interests or rights and freedoms, or to process your Personal Data solely for the establishment, exercise or defence of legal claims.

Please note that in the case of a request sent by email, we will need to verify your identity or identify you in some way.

If you believe that the processing of your Personal Data has violated the law, you also have the right to lodge a complaint with a supervisory authority, in particular in the country of your habitual residence, place of employment or place where the alleged violation occurred. This supervisory authority for the Slovak Republic is the Office for Personal Data Protection of the Slovak Republic, located at Hraničná 12, 820 07 Bratislava 27, Slovak Republic, ID No.: 36 064 220, www.dataprotection.gov.sk.
